Transparency and Disclosure Requirements for Applicants to MEKRA Lang GmbH & Co. KG

This Privacy Policy provides you with comprehensive information about how MEKRA Lang GmbH & Co. KG processes your personal data and about your rights in connection with the application process. We are aware of the importance of your data and process the personal data you provide during the application process solely for the purpose of handling the application and for the necessary communication related to the application process.

Rights of Data Subjects

First, we would like to inform you here about your rights as a data subject. These rights are set forth in Articles 15–22 of the EU GDPR. This includes: 

  • The right of access (Art. 15 EU GDPR) 
  • The right to rectification (Art. 16 EU GDPR) 
  • The right to erasure (Art. 17 EU GDPR) 
  • The right to restriction of processing (Art. 18 EU GDPR) 
  • The right to object to processing (Art. 21 EU GDPR) 
  • The right to data portability (Art. 20 EU GDPR)

To exercise these rights, please contact datenschutz@mekra.de. The same applies if you have questions about data processing in our company or wish to withdraw your consent. You may also lodge a complaint regarding data processing with a data protection supervisory authority. 

 

Recipients of the data/categories of recipients

Within our company, we ensure that only those departments and individuals who require access to your application data for the purpose of conducting the application process or fulfilling legal obligations are granted access. 

We will only disclose your data to third parties within the scope of legal provisions or with your consent (e.g., to other affiliated business units). Otherwise, data will not be disclosed to third parties unless we are required to do so by mandatory legal provisions (disclosure to external bodies such as supervisory authorities, tax authorities, or law enforcement agencies).  

In some cases, service providers assist our departments in fulfilling their tasks. For example, we are supported by the service provider Perspective Software GmbH (Müggelstraße 22, 10247 Berlin) in providing the online application portal. The necessary data protection agreements have been concluded with all service providers used. 

 

Transfer to Third Countries/Intention to Transfer to Third Countries

Data transfers to third countries (outside the European Union or the European Economic Area) only take place if you have given us your consent or if this is required by law.

We do not (currently) transfer your personal data to any service providers or group companies outside the European Economic Area.

 

Categories/Source of Data

  a) Application form

As part of the application process, we process the following personal data from you:

  • Your basic information (last name, first name, additional names, date of birth, photo, work permit, residence permit) 
  • Contact information (address, phone number, email address) 
  • Qualification data (resume, cover letter, degrees)

Your personal data is generally collected directly from you as part of the application process. 

In addition, we use personal data that we have lawfully obtained from publicly available sources (e.g., professional networks). 

 

Purposes and Legal Bases for Data Processing

When processing your personal data, we always comply with the provisions of the EU GDPR, the BDSG, and all other applicable (labor) laws.

We are aware of the importance of your data. Your personal data is processed exclusively for the purpose of effectively and correctly handling the application process and for contacting you as part of the application process (Art. 88(1) EU GDPR in conjunction with § 26(1) BDSG). 

In addition, we process your data if we are legally obligated to do so, particularly under labor law. For special categories of personal data pursuant to Art. 9(1) EU GDPR, a balancing of interests also takes place; that is, data processing occurs only if your legitimate interests do not outweigh those of the controller (Art. 88(1) EU GDPR in conjunction with § 26(1), (3) BDSG).

Your consent also constitutes authorization for data processing. Furthermore, the aforementioned consent also serves as consent to the transfer of application documents to other business units. In this case, we also process your data for this purpose (Art. 88(1) EU GDPR in conjunction with § 26(2) BDSG). When we obtain your consent, we will, of course, inform you of the specific purpose of the data processing and your right to withdraw consent.  

 

Data Retention Period

We store your application data until the application process is completed, or until we no longer need your data for the purposes mentioned above, or until you have withdrawn your consent. Should we enter into an employment relationship with you, the relevant application data will continue to be stored by us as long as it remains relevant for the performance of the employment relationship. 

If we unfortunately have to reject your application, we will delete your application documents no later than 6 months thereafter.  

 

Obligation to provide data

The decision on whether or not to establish an employment relationship with you can only be made if you provide us with certain personal data, such as your resume. In doing so, we naturally adhere to the principles of data minimization and data avoidance, meaning you are only required to provide us with the data we need to fully review your application documents or that we are legally obligated to collect.

Without this data, we unfortunately cannot review your application documents.  

Of course, you have the option of voluntarily providing us with additional information in your application documents.   

 

Automated Individual Decisions 

We do not use purely automated processing procedures to make a decision.
